Sales Policy

Please ensure that you read the following terms carefully. The ensuing terms, conditions, and policies oversee usage of the Seginus Lighting site and all business relations with Seginus Lighting. By ordering and using this site you agree to the acceptance of these terms and conditions. Your submittal of any purchase order and placement of an order to Seginus Lighting indicates that these terms and conditions are accepted by you. These terms and conditions shall supplant any later terms and conditions included with any purchase order, regardless of Seginus Lighting signing such terms and conditions. These terms and conditions are subject to change, at any time, without prior written notice, at Seginus Lighting's lone discretion.

Accepting Orders
Seginus Lighting reserves the right to accept, deny, or cancel your order for any reason after receipt of the order. Additional verification and other information may be required prior to order acceptance.

Additional Documents
These terms and conditions may not be augmented, changed, or modified by the use of any other document(s). Any attempt to augment, change, or modify this document, or to enter an order for product(s) which are bound by additional or altered terms and conditions will be null and void, unless otherwise accepted via written agreement signed by both the customer and Seginus Lighting 

Applied Finance Charges
Finance Charges will be applied to any payment that is past due including but not limited to payments past due according to a comprehensive payment plan, insufficient funds checks, payments made by credit card or another method which are wrongly charged back or in any way not honored by the card issuer. This also includes any instance in which payment is overdue or otherwise beyond the agreed upon due date. Finance Charges in the amount of 1.75% per month (corresponding ANNUAL PERCENTAGE RATE 21.0%) are applied to all invoices with balances past due.

Chargeback Policy
In the event of a credit card chargeback which is consequently found to be in error, you agree to rectify the error within 10 days of receiving notification of such error. You also agree to pay Seginus Lighting a dispensation of $50.00 USD for any chargebacks found to be in error. You confirm and approve that this amount will be charged against your credit card. Additional monies due will be paid via money order or bank cashier's check and in USD currency within 30 days from date of the notification of the error.

Honoring Dues and Expenses
In the case of any legal action, the "losing party" shall be accountable to the prevailing party for all judicious fees and expenses incurred by the prevailing party in the prosecution or defense of the action.

Limitations of Liability and Disclaimer Relating to Sold Products
Seginus Lighting guarantees each product against deficiencies up to 30 days from the date of the invoice. Apart from what is specifically stated herein, Seginus Lighting makes no representations or warranties, either expressed or inferred, of any kind with respect to products sold on SeginusLighting.com. Seginus Lighting explicitly disclaims all warranties, expressed or inferred, of any kind with respect to items sold on this website. This does include but is not limited to, merchantability and fitness for particular purpose. You agree that the only liability to Seginus Lighting arising from any product sold on Seginus Lighting site will be the price of the product ordered, maximum. At no point will Seginus Lighting, its directors, officers, employees and representatives be liable for special, incidental, substantial, or punitive damages related to product(s) sold. Seginus Lighting does not warranty any light bulbs that are sent with fixtures as they are considered strictly complementary.

Seginus Lighting expressly renounces all warranties, articulated or inferred, of any kind with respect to the site or its use, including but not limited to fitness for a particular purpose and merchantability. You agree that Seginus Lighting, its directors, officers, employees and representatives are not liable for damages arising from the operations, content, or usage of Seginus Lighting site. You agree that this limitation of liability is all-inclusive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, supplementary, punitive and substantial damages.

Paying via Credit Card
By paying with a credit card on this website, you certify that you are the legal cardholder of the credit card and have legally submitted its information. All cases of possible credit card fraud will be investigated by Seginus Lighting and your information will be provided to the credit card issuer. Please note that your credit card is billed upon receipt of your order.

Security Measures
Seginus Lighting does not hold credit card information in our database. Your credit card information is never seen. Clicking on a link to place an order redirects you to our credit card processor to enter and process the transaction. You will receive an email from the credit card processor with your order number. Products will not be shipped until we have a full authorization from the credit card issuer.

Typographical Errors
In the event Seginus Lighting lists an item on our website at an incorrect price or with inaccurate information due to typographical error, or due to an inaccuracy in pricing or product information as received from our suppliers, we possess the right to refuse or cancel any orders placed for the product listed at the incorrect price. Seginus holds the right to refuse or cancel any such orders whether or not the order has been confirmed and your bank account charged. If your bank account has already been charged for the purchase and your order is canceled for these reasons, a full refund will immediately be issued to your bank account for the amount of the charge.
